Poised.co.uk - General terms and conditions of business

The following terms and conditions apply to all transactions on the poised.co.uk website. We reserve the right to change these terms and conditions and we advise you check them from time to time. Use of the website indicates your acceptance of these terms and conditions. You must be over the age of 18 and have a valid credit or debit card in order to use the website.

1. Definitions

The following expressions have the following meanings in these terms and conditions unless the context of the text specifies otherwise:

‘Poised’ or ‘Poised.co.uk’ or ‘the website’ means the internet site who’s domain is www.poised.co.uk.

‘The customer’ or ‘customer’ means the individual or company who places an order with Poised for the supply of goods.

‘Products’ or ‘Goods’ means any products or goods supplied by Poised to the customer in accordance with these terms and conditions.

‘Price’ means the advertised price for the products or goods either individually or as part as the total price shown at the checkout stage. Prices shown are inclusive of VAT but may be exclusive of postage charges.

‘Order(s)’ means the electronic order generated on the website by the customer for the supply of goods 

2. Pricing

The purchase price for each product is shown on the website and whilst we try and ensure that all prices are accurate, errors can occur. Poised reserves the right to reasonably amend any product price or order to remedy any errors caused by typographical or system faults. If we discover a fault in the price of a product in a customer order we will contact the customer as soon as possible and provide the option of reconfirming the order at the correct price or cancelling the order.

3. Payment

Payment for orders will be taken at the point of payment processing, at the checkout stage, on the website. Payments are handled by using our secure payment partner, Sage Pay. 

4. Availability

In the event that products are not immediately available for delivery following receipt of an order we will contact the customer as soon as possible and provide the option of issuing replacement products or cancelling the order.

5. Delivery

Delivery costs are calculated at the checkout stage and clearly advertised on the website. For full details please check the delivery section on our help page.  The delivery method is subject to change and at our discretion.

6. Refunds 

Refunds and returns are covered fully by our returns policy. These terms and conditions must be read in conjunction with this policy.

7. Promotional Codes

From time to time we may issue promotional codes to be used in conjunction with an order. These codes will qualify the customer for special offers which will be detailed as advertised. The following terms apply to the use of promotional codes:

(1) Where a promotional code is in relation to a discount on an order, this cannot be refundable for cash.

(2) Where a promotional code is in relation to money off an order, the total value of the order must exceed the value of the promotional code.

(3) Where the promotional code is in relation to free delivery, this applies to the UK only (unless specifically stated)

(4) Where a promotional code is in relation to a free item or gift with purchase, we reserve the right to substitute items for a reasonable equivalent without prior notice.

(5) Only one promotional code may be used per order.

(6) Promotional codes carry a ‘valid until’ date and cannot be used after this time.

 8. Description of Goods

All product images, descriptions, specification, ingredients, direction and other related sale material on Poised.co.uk are as accurate as possible. From time to time, mistakes do occur and we will endeavour to amend these as quickly as possible. It is our aim to represent the manufacturers brand as accurately as possible and because of this; product images and notes are sometimes obtained from them. These details must not be copied from the website without prior consent from Poised.co.uk and the manufacturer.

All product details are kept as up to date as possible but we are unable to guarantee their accuracy and therefore accept no liability for this.

9. Force Majeure

Poised.co.uk shall not be held liable for any late delivery or processing of orders as a result of conditions beyond its control such as, but not limited to, war, strikes, fires, floods and adverse weather conditions, acts of God, governmental restrictions, power failures, or damage or destruction of any network facilities or servers. In the event of any delays caused by events outside of our control we will endeavour to contact customers within 24 hours.

The use of this website is subject to the following terms of use:

(1) The content of the pages of this website is for your general information and use only. It is subject to change without notice.

(2) Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. 

(3) Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements. 

(4) This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions. 

(5) All trademarks reproduced in this website, which are not the property of, or licensed to the operator, are acknowledged on the website. 

(6) You must not submit any message or review to the website that is abusive, obscene, or likely to cause offence, inconvenience or damage to either Poised or our customers. We reserve the right to reject any order placed and remove any comments from the website on this basis. 

(7) Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence. 

(8) From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

(9) You may not create a link to this website from another website or document without our prior written consent.

(10) Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Scotland and Wales.
